In der vorliegenden Arbeit wird eine normative Analyse und Verteidigung der Erbschaftssteuer unternommen. Zunächst wird eine egalitaristische Argumentation für die Steuer entfaltet. Aufgrund ihrer progressiven Struktur ist die Erbschaftssteuer ein geeignetes Instrument, um der wachsenden ökonomischen Ungleichheit entgegenzuwirken und letztlich verschiedene egalitäre Ideale (politische Gleichheit, Chancengleicheit etc.) zu befördern. Anschließend wird untersucht, wie aus normativer Perspektive zu beurteilen ist, dass der Erblasser bei Erhebung der Steuer nicht mehr lebt. Die restliche Arbeit besteht in einer Auseinandersetzung mit den wichtigsten Einwänden gegen die Erbschaftssteuer. So wird oft behauptet, diese verletze die natürlichen Eigentumsrechte des Erblassers bzw. des Erben und sie ignoriere zudem die Verdienstansprüche des Erblassers. Schließlich sei die Steuer aus diversen "familien-basierten" Erwägungen abzulehnen. Nicht nur werden diese Einwände erfolgreich zurückgewiesen; ferner wird gezeigt, dass einige der, diesen Argumenten zugrundeliegenden, Prinzipien selbst zur Verteidigung einer egalitären Erbschaftssteuer (also einer Erbschaftssteuer, die aus egalitären Prinzipien folgt) herangezogen werden können.

Politische Akteure rekurrieren zur Rechtfertigung ihres Handelns wieder verstarkt auf die Idee des allgemeinen Wohls. Kann die politische Philosophie eine Bestimmung des Gemeinwohls anbieten, anhand derer sich gerechtfertigte von ungerechtfertigten Gemeinwohlrekursen unterscheiden lassen? Das Paradigma des Prozeduralismus besagt, dass das Gemeinwohl allein uber die Angabe formaler Verfahrenskriterien als Output eines wohlgeordneten demokratischen Systems definiert werden kann. Der Autor weist dieses Paradigma zuruck und optiert fur eine integrative Gemeinwohltheorie. Diese besteht aus zwei Komponenten. Erstere besagt, dass die Mitglieder eines Gemeinwesens durch demokratische Verfahren, die der Umsetzung ihrer subjektiven Interessen dienen, selbst festlegen konnen, worin das Gemeinwohl besteht - es sei denn, sie verstoen damit gegen objektive und prozedurtranszendente Mindeststandards. Die zweite Komponente besteht aus einem Katalog dieser Standards, die festlegen, welche Outputs entgegen dem Fur-Gut-Halten der Mitglieder gemeinwohlschadlich oder -irrelevant sind. Somit ergibt sich die Gemeinwohldienlichkeit einer Handlung daraus, dass diese demokratisch autorisiert ist und objektiv-prozedurtranszendente Mindeststandards nicht verletzt.

Demokratische Territorialstaaten besitzen die Souveränität, über die Verteilung ihrer Mitgliedschaftsrechte unilateral zu entscheiden. Damit werden jedoch nicht nur ihre Mitglieder, sondern auch alle Nicht-Mitglieder durch demokratisch verabschiedete Mitgliedschaftsnormen adressiert. Diese Untersuchung erörtert, ob unilaterale Einwanderungsbeschränkungen ein Demokratiedefizit darstellen und argumentiert dafür, dass dies zutrifft, sofern demokratische Territorialstaaten entweder faktische Mitglieder mit sozialen oder ortsabhängigen Bindungen zu dem politischen Kollektiv oder geographischen Territorium exkludieren oder aber eine egalitaristische Verteilungsstruktur territorialer Rechte verletzen. Hierdurch versucht diese Arbeit, einen Beitrag zu leisten, demokratietheoretische und territorialrechtliche Ansätze miteinander zu verknüpfen und nicht nur die politischen, sondern auch territorialrechtlichen Externalitäten staatlicher Ausschlussrechte in einer globalisierten Welt zu reflektieren.

Was ist der Mensch? Von den zahlreichen Aspekten dieser Frage, denen es nachzugehen lohnt, kommt die begriffliche Aufklarung wesentlicher Zuge des menschlichen Daseins aus der "e;ich"e;-Perspektive der eigentumlichen Zielstellung philosophischer Reflexionsbemuhungen wohl am nachsten. Die Frage betrifft dann speziell jene Strukturelemente, die fur unser vorgangiges Selbst- und Weltverstandnis konstitutiv erscheinen - etwa die Idee eines Bewusstseinssubjekts und seiner zeitubergreifenden Identitat, einer in der objektiven Welt mit anderen Bewusstseinssubjekten interagierenden Person oder eines moralisch verantwortlichen Akteurs - und die rationalen Beziehungen zwischen diesen Elementen. Der traditionelle Rahmen derartiger Untersuchungen wird in dieser Studie insofern erweitert, als neben philosophischen auch neuere psychologische Debatten einbezogen werden.

Christian Hiebaum examines the political dimension of legal argumentation. He shows how two prevalent beliefs which seem to contradict one another are, in fact, compatible: the belief that the application of law is a political undertaking, and the belief that those who apply law necessarily act in a truth-oriented manner. This demands a thorough analysis of the interpretation of legal standards on the one hand, and of the concept of common welfare and its role in legal discourse on the other. Overall, the analysis is set up as a deconstruction of Dworkin's distinction between arguments of principle and arguments of policy. In contrast to similar projects, this analysis does not flow into convenient skepticism or relativism.
