In der Demokratischen Republik Kongo ist die Zahl der NGOs, die in verschiedenen Bereichen des sozialen Lebens tätig sind, erheblich und komplex gestiegen. In meiner Eigenschaft als Jurist, Forscher und Beobachter des Lebens der gemeinnützigen Organisationen, der die Organisation und Funktionsweise der NGOs verstehen möchte, war es wichtig, diesen Leitfaden zu erstellen, um einerseits den rechtlichen Formalismus im Hinblick auf das geltende Gesetz zu erfüllen und andererseits unsere Analysen und Beobachtungen vorzutragen, um den Mangel an Vereinsgeist und Extrovertiertheit, der die Mehrheit der kongolesischen NGOs belebt, anzuprangern. Das Hauptziel dieser Arbeit ist es, die NGOs des Nordens in ihrem Kampf gegen Armut und Anti-Werte zu ermutigen, zuerst den Menschen aufzubauen, der die Verantwortung für die Zukunft seiner Gesellschaft übernimmt, und nicht nur einen einfachen Verwalter eines Projekts, das im Westen von Experten entworfen wurde, die in den meisten Fällen die kongolesischen Schwierigkeiten nicht kennen. Seine NGOs helfen unterentwickelten Ländern dabei, einen langen Weg zu Rechtsstaatlichkeit und sozialem Wohlstand zu gehen.

Au choque de démocratie, la citoyenneté congolaise en détresse part one is a book that describes in a few lines, through an analysis based on real facts, the deplorable situation of violation of public and civic freedoms enshrined in the constitution of February 18, 2006 in the Democratic Republic of Congo. Indeed, the deterioration of the critical human rights situation has led to a lack of trust between the governing and the governed as a result of the failure to organize elections in December 2016, as stipulated in the constitution, and the international instrumentalization of the country's political situation. The present work is intended to enlighten public opinion on the political impasse and the risks it could engender in the days to come if the Congolese political class does not put things back on the right track. And finally, a constitutional solution has been proposed.

After a long journey of university study, the writing of this work sanctions and represents so many combined efforts and sacrifices made. Certainly, this work on the functioning of the political institutions of the D.R.Congo from 2006 to 2011 is necessary since it is likely to contribute to future scientific research and to bring certain lights on the way in which the political institutions of the country functioned since the entry into force of the constitution of February 18, 2006. On this, we are obliged to express socially our gratitude towards any person having contributed morally, materially and scientifically to the achievement of this work.

The Democratic Republic of Congo is experiencing a significant and complex growth of NGOs operating in different sectors of social life. In my capacity as a legal researcher and observer of the life of ASBLs and wanting to understand the organisation and functioning of NGOs, it was important to put in place this guide in order to respond on the one hand to the legal formalism with regard to the law in force and, on the other hand, to bring our analyses and observations in order to denounce the lack of associative and extrovert spirit which animates the majority of Congolese NGOs. The main objective of this work is to encourage the so-called Northern NGOs in their fight against poverty and anti-values to first build the man who will take charge of the future of his society and not a simple manager of a project conceived in the West by experts who, for the most part, do not know the Congolese difficulties. Its NGOs help underdeveloped countries to undertake a long journey towards the rule of law and social well-being. Affirming the need for a change of mentality in the operating system of Congolese NGOs.
