Die Geschichte der Justizverwaltung, die den Justizministerien sowie den Gerichtspräsidenten und den Generalstaatsanwälten zusteht, ist bisher, von der NS-Zeit abgesehen, für das 20. Jahrhundert nur selten Gegenstand besonderer rechtsgeschichtlicher Darstellungen gewesen. Eine wichtige Quelle für die Justizverwaltungsgeschichte bilden die in der Edition wiedergegebenen Protokolle der Beratungen der Justizministerien Bayerns und Preußens mit den Präsidenten der Oberlandesgerichte und den Generalstaatsanwälten von 1917 bis 1934. Ferner werden wiedergegeben die Protokolle von vier Tagungen der Landesjustizminister von 1933-1934. Themen der Beratungen waren u.a.: Richterbesoldung, dienstliche Beurteilung der Richter, bedingte Begnadigung, Pressestellen der Gerichte, Simultanzulassung von Rechtsanwälten, Juristenausbildung und 1933/34 Berufsverbot für jüdische Rechtsanwälte sowie das Verhältnis zwischen den Parteistellen und der Justiz in Bayern.

Esta colección de ensayos incide en las nuevas aproximaciones a la traducción literaria y otras variedades de traducción desde una perspectiva lingüística y cultural, en la que se demuestra cómo los traductores deben poseer un dominio tanto de las competencias lingüísticas como un conocimiento amplio de las circunstancias históricas y socio-culturales que rodean al texto con el fin de poder transmitir del modo más completo y fiel los contenidos del texto original.

The Technological Unconscious in Contemporary Fiction in English analyzes the way in which contemporary English-language prose explores the role that the broadly understood environment plays in shaping human consciousness, with particular emphasis on technological aspects of this environment. The discussion of the chosen literary texts aims to demonstrate that contemporary narrative fiction in English presents consciousness as inextricably linked with the surrounding technological environment. Using a wide range of narrative techniques and referring to a variety of consciousness models, the analyzed texts also show that the connection between technology and consciousness is often invisible to the human agent due to the ubiquity and transparency of the technology.

Commitment is connected to central linguistic features, such as modality and evidentiality. It has thus been investigated in many branches of the field. Building upon this heterogeneous literature, this book offers a cognitive pragmatic account of the processes involved in utterance interpretation, crucially when the hearer assesses the level of commitment linked to it. This research illustrates that the relevance-theoretic notion of strength can be used to capture the cognitive effects of commitment markers (as I think that X, I am sure that X, etc.). The author¿s model is based on a novel typology as well as predictions which were experimentally tested. The results show that commitment to an utterance is indeed cognitively determined by the strength of the hearer¿s corresponding assumptions.

How do people with and without disabilities work together in the artistic process? This volume is a compilation of 14 interviews with directors and producers of European feature films that enriches the understanding of interabled dynamics in creative ventures. It highlights the work of actors with learning disabilities, along with, behind the scenes knowledge of the casting process, training methods, brainstorming sessions to incorporate their inputs, production process, unforeseen challenges that they encounter on sets and the critical and audience reception of the film. En este libro se presentan los fundamentos y los resultados de la investigación sobre el vocabulario disponible de los hablantes de la ciudad de Málaga. Esta investigación reúne y hace compatibles la línea tradicional de disponibilidad léxica y la línea específica de este trabajo, que se centra en la capacidad léxica de los hablantes. La primera conduce a la elaboración del diccionario de disponibilidad de la ciudad de Málaga obtenido a partir de cuestionarios basados en centros de interés; ello permite establecer comparaciones con trabajos precedentes realizados con estudiantes preuniversitarios y nos provee de un material de gran interés para el mejor conocimiento de la lengua española hablada en Málaga. La segunda línea pretende confirmar determinadas hipótesis sobre la determinación que la posición social y otras variables de hablante ejercen sobre el vocabulario virtual de los individuos.

Zuerst wird eine Einführung in die allgemeine Funktionsweise einer Blockchain gegeben, wobei Token, kryptografische Schlüssel, Smart Contracts und Konsensmechanismen wie Proof-of-Work und Proof-of-Stake erläutert werden. Danach werden dezentrale und zentrale Einsatzmöglichkeiten einer Blockchain für die Register untersucht. Er kommt zu dem Ergebnis, dass sowohl das Grundbuch als auch das Handelsregister durch eine Blockchain keinen deutlichen Mehrwert erhalten würden. Dagegen habe die Tokenisierung von Aktien in einem blockchainbasierten Aktienregister einige Vorteile, die den Einsatz einer Blockchain rechtfertigen würden.

Esta monografía ofrece un modelo de integración de terminología y ontología para la representación y organización de una parcela de la comunicación especializada, concretamente del dominio de la seguridad de la navegación marítima a bordo del buque, con el objetivo de elaborar un recurso término-ontológico bilingüe (inglés-español). Este estudio viene a cubrir la carencia detectada de recursos terminográficos sobre la seguridad de la navegación marítima y aporta un procedimiento para la aplicación de las ontologías a las lenguas de especialidad. La obra consta de cuatro partes: en la primera, se exponen los conceptos clave en terminología y ontología y la metodología de elaboración de la término-ontología, la cual se describe pormenorizadamente en la segunda y tercera parte. Tras la formalización ontológica en la cuarta parte, se describe el tránsito del recurso ontológico a un glosario término-ontológico electrónico bilingüe, disponible en línea, que se acompaña. Este glosario basado en corpus está dirigido a profesionales de la navegación, el transporte marítimo y la industria naval, a docentes y estudiantes de titulaciones náuticas, así como a profesionales de las lenguas especializadas (profesores, traductores, intérpretes, redactores técnicos, etc.).

Die heute auch im kontinentaleuropäischen Insolvenzrecht etablierte Dogmatik der Restschuldbefreiung für natürliche Personen hat ihren Ursprung in der angloamerikanischen Rechtsfigur der bankruptcy discharge. Diese Arbeit untersucht die Entstehung der bankruptcy discharge ab dem frühen 18. Jahrhundert im englischen Recht. Einen weiteren Schwerpunkt legt die Arbeit auf die Entwicklung der Rechtsfigur im US-amerikanischen Recht des 19. Jahrhunderts. Die Untersuchung nimmt dabei Bezug auf die historischen Grundbausteinen des römisch-kontinentalen Insolvenzrechts, die das angloamerikanische Recht ab dem 16. Jahrhundert teilweise übernahm und im eigenen Rechtsumfeld weiterentwickelte.

Kann es einen Betrieb ohne Gewinnerzielungsabsicht geben? Dieser Frage widmet sich der Autor dieser Arbeit. Im ersten Teil der Arbeit wird die Rechtsprechung des Bundesfinanzhofs zu sog. schlafenden Betrieben nachgezeichnet. Der Autor untersucht das Verhältnis von Gewinnerzielungsabsicht, steuerlichem Betriebsbegriff sowie Betriebsvermögen und stellt der Rechtsprechung eine eigene Lösung gegenüber, wonach Betriebe ohne Gewinnerzielungsabsicht nicht denkbar sind. Diese Auffassung sichert der Autor anschließend verfassungsrechtlich ab.

L¿esperienza della pandemia da Covid-19 ha cambiato il modo di parlare di malattia, creando nuove connessioni tra l¿esperienza privata e la sua rappresentazione pubblica. Per quanto già esistesse, soprattutto nella critica americana, una consistente riflessione sulla componente narrativa della malattia e si percepisse l¿esigenza di analizzarla in un¿ottica letteraria, gli eventi hanno reso urgente un¿analisi sulle intersezioni tra letteratura e medicina. Il volume investiga la traduzione retorica e narrativa dell¿esperienza della malattia : dal linguaggio alle strategie testuali, alle interferenze con la scienza, alla presenza di un immaginario non sempre affidato alla parola. I saggi si confrontano con il rimosso e con il trauma, con le afasie e il pudore di esperienze private o con il valore quasi epico e fondativo di quelle collettive, restituendo la complessità di un dibattito scientifico e interdisciplinare, e rispondendo all¿esigenza di interrogarsi su uno scambio reciproco tra letteratura e medicina.

The curricular reform of 2016 presented us with a unique opportunity to compare children who had followed the previous early childhood curriculum in Slovakia with children who attended preschool after the successful implementation of the new preschool curriculum. Our book is based on the findings of research carried out in the ecologically valid environment of Slovak preschools. The results offer a unique perspective on literacy development in the context of a national reform implementation that had a direct impact on educational practice.

La responsabilité sociale en santé fait actuellement l¿objet d¿une attention croissante à travers le monde, et est souvent présentée comme l¿une des réponses nécessaires à l¿amélioration des systèmes de santé dans les pays développés. L¿absence de données africaines à ce sujet a motivé la réalisation d¿une enquête, qui avait pour but d¿évaluer la responsabilité sociale des hôpitaux publics africains en termes de prise charge de la maladie rénale, et d¿explorer les facteurs qui l¿influencent en se basant sur les perceptions des patients et des médecins. Le présent travail a mis en exergue le rôle crucial de la gouvernance et de la gestion hospitalières, en impliquant les différentes parties prenantes, dans l¿amélioration de la responsabilité sociale des hôpitaux, et par conséquent l¿offre de soins.

Attempts to conceal grammatical gender, dictated by the "inclusive" desire to overcome the simple distinction between masculine and feminine (gender binarism) and make room for the neutral, affect the national languagesof a variety of Western countries with increasing frequency and intensity, with the risk of weakening or compromising the functioning of the languages¿ supporting structures. A grammatical innovation has a very different impact from a neologism, and when that innovation, under the excuse of inclusion, ends up infiltrating a public act, or any other text issued or produced by a public entity, penetrating it in a pervasive way, the institutional endorsement should set off the alarm bells. In our case, simplicistically overlapping two levels that must instead be kept distinct ¿ one "structural" (technical-linguistic) and the other "superstructural" (socio-cultural) ¿ means that, in the growth economy of an entire community of speakers and writers, the structures of an idiom, above all if stratified over time, are bent to accommodate the desires of those who, against all logic and the most elementary common sense, expect immediate changes that would upset or crack the linguistic system. This ends up making even the simple decodingof information difficult.

As Ireland¿s oldest revolutionary movement and Americäs oldest transatlantic nationalist organization this is the first book covering the entire history of Clan na Gael. Formed in 1867 and existing up to the present Clan na Gael has been involved directly and indirectly in every violent revolutionary attempt for Irish independence and unification since its formation 155 years ago. Despite this long history it is the least studied and most underappreciated of Ireland¿s revolutionary movements. A large part of this is due to academic bias and major under appreciation as to the role of Irish America within the broader struggle for Irish independence. Clan na Gael¿s influence also went well beyond the borders of Ireland. Within the U.S Clan na Gael proved a major model of influence and inspiration for movements such as Zionism, Indian nationalists, African American nationalists and even the Suffragette movement among others. This book attempts to give this long-neglected movement its proper place within the annals of Irish history as well as that of Anglo-American relations and transatlantic nationalism.

Dabei geht sie sowohl auf die Grundlagen der Straftheorie als auch auf allgemeine verfassungsrechtliche Anforderungen ein. Um dogmatische Fragen zufriedenstellend zu klären, bedient sich die Autorin interdisziplinärer Ansätze wie Rechtsgeschichte, Psychologie und Soziologie.Sie analysiert, ob die Strafbestimmungen der neuen Gesetzentwürfe ein legitimes Ziel verfolgen und ob die Maßnahme zur Erreichung dieses Ziels als Strafe besonders geeignet, erforderlich und angemessen ist.

Der vorliegende Band bietet eine systematische Analyse des slowenischen Basiswortschatzes im Hinblick auf die in ihm vorkommenden lexikalischen Entlehnungen. Auf der Grundlage einer Wortliste mit über 1400 Bedeutungen und deren Untergliederung in 24 lexikalisch-semantische Gruppen werden die Gesamtanzahl an Entlehnungen und die thematischen Präferenzzonen für Entlehnungen ermittelt. Die chronologische Einordnung zeigt, dass das maßgebliche Inventar an Entlehnungen bereits in früheren Zeiten übernommen wurde. Im Hinblick auf die Gebersprachen sind keine dominanten Einflüsse nachzuweisen. Aus einer gebrauchsbasierten Perspektive zeigt sich, dass die Entlehnungen eine periphere Rolle einnehmen und hauptsächlich im mittel- und niederfrequenten Bereich zu finden sind. Darüber hinaus ist auch ihr semantisches Potenzial begrenzt.
